General Terms and Conditions of MG BikeTec GmbH

§1 Applicability to entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) "Consumer" for the purposes of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity.

§2 Conclusion of a contract, storage of the contract text

(1) The following provisions regarding the conclusion of the contract apply to orders via our Internet shop http://www.mg-biketec.com.

The order is made in the following steps:

1) Selection of the desired goods

3) Checking the details in the shopping cart

§3 prices, shipping costs, payment, due date, cancellation

(1) The indicated prices include the statutory sales tax and other price components. In addition there are any shipping costs.

(2) The consumer has the option of paying in advance per bank transfer, PayPal or credit card

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after the conclusion of the contract.

§4 delivery

(1) Unless stated otherwise in the product description, all items offered by MG Biketec are ready for shipment within 3 working days.

(2) If the consumer has chosen to pay in advance, MG Biketec will not ship the goods until the funds are received.

§5 retention of title

We reserve the ownership of the goods until full payment of the purchase price.

§6 right of withdrawal

Cancellation

You can cancel your contract within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the case before the deadline - by returning the goods. The period begins after receipt of this instruction in writing, but not before receipt of the goods at the recipient (in the case of recurrent delivery of similar goods not before receipt of the first partial delivery) and not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 para 1 and 2 EGBGB as well as our obligations according to § 312g Abs. 1 Satz 1 BGB in connection with article 246 § 3 EGBGB. To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.

Consequences of Withdrawal

In the case of an effective revocation, the mutually received benefits and any benefits (eg interest) surrendered. If you can not give us back or give us the received performance as well as uses (eg benefits of use) or only partially or only in a deteriorated condition, you have to pay us compensation. For the deterioration of the thing and for drawn uses, you only have to pay compensation if the use or the deterioration is due to a handling of the thing, which goes beyond the examination of the characteristics and the functioning. Parcel shipping items are to be returned at your risk. You have to bear the cost of returning. Obligations to reimburse payments, less transaction fees incurred, must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.

§7 Contractual regulation concerning the return costs upon revocation

If you make use of your right of withdrawal, then in accordance with Article 4, § 11 of the Distance Selling Act, stated that the costs of the returns are to be paid in full by the buyer.
Attention: any return, may not be unfree, unfree packages are not accepted by MG Biketec!
 
§8 contract language

§8 warranty period
 
The minimim European required warranty period is - as long as no other regulation exists - two years from delivery of the goods. Consumers are kindly asked to report obvious defects to the goods in writing within two weeks of receipt. The omission of the advertisement has no influence on the legal warranty claims of the buyer. Defective items will be replaced immediately. Consumers have the choice of whether the subsequent performance is to be done by repair or replacement. The seller is entitled to refuse the type of supplementary performance chosen, if it is possible only with disproportionate costs and the other type of subsequent performance without significant disadvantages for the consumer remains. If the supplementary performance fails, the customer may, at his discretion, demand a reduction of the remuneration (reduction) or cancellation of the contract (withdrawal) as well as damages. For only minor defects, the customer has no right of withdrawal. If the customer chooses damages, the following limitations of liability apply.

§9 Liability for damage
 
The liability for contractual breaches of duty and tort is limited to intent and gross negligence. This does not apply to injury to the life, body or health of the purchaser, claims for breach of primary obligations and compensation for damages caused by default. In that regard, the seller is liable for any degree of fault. Insofar as the seller's liability for damages is excluded or limited, this also applies with regard to the personal liability for damages of employees, employees, employees, representatives and vicarious agents. In particular, the seller is not liable for non-specific product-related information and tips that are offered free of charge as well as hyperlinks that refer to third-party offers.
 
§10 TÜV / Technical Information
 
The products sold lose their TÜV, ABE or EC / ABE approval if they are rebuilt on their own initiative. When using parts without TÜV, ABE or EC / ABE the general operating permit of the vehicle expires. The certificates (TÜV, ABE or EC / ABE) are the property of MG BikeTec GmbH. These reports are protected by copyright and may not be publicly accessible or reproduced or distributed without the consent of MG BikeTec GmbH. Any offense will be prosecuted.
